Terms of Use for Sportobot

1. Agreement to Terms

By downloading, accessing, or using the Sportobot mobile application and website (collectively, the "Service"), you agree to be bound by these Terms of Use ("Agreement"). If you do not agree to abide by the above, please do not use this service.

Sportobot ("Company," "we," "us," "our") reserves the right to modify these terms at any time. Your continued use of the Service following notification of changes constitutes your acceptance of the updated terms.

2. User Eligibility

2.1 Age Requirements

• Users must be at least 13 years old to use Sportobot
• Users under 18 ("Minors") must have parental/guardian consent
• We comply with applicable children's privacy laws (COPPA in the US, GDPR Article 8 in the EU)
• By creating an account, you represent that you meet these age requirements

2.2 Account Responsibility

• You are responsible for maintaining the confidentiality of your account credentials
• You agree not to share your password or allow others to access your account
• You are liable for all activities that occur under your account

3. License and Permitted Use

3.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install Sportobot on your personal device
• Use Sportobot for lawful purposes in accordance with these Terms

3.2 Permitted Activities

• Create, join, and manage sports events and tournaments
• Communicate with other users for event organization and participation
• Upload and share event-related content (photos, videos, results, statistics)
• Access event information and participant details relevant to your involvement

3.3 Restrictions on Use

You agree not to:

Prohibited Content:

• Upload, post, or transmit illegal, harmful, defamatory, threatening, harassing, abusive, obscene, or otherwise objectionable content
• Share content that infringes on intellectual property rights
• Post spam, unsolicited advertisements, or promotional material
• Upload malware, viruses, or any code intended to disrupt service functionality
• Share sexually explicit, child exploitation, or non-consensual intimate images
• Distribute content that violates any laws or regulations

Prohibited Behavior:

• Harass, bully, threaten, intimidate, or abuse other users
• Impersonate other individuals or misrepresent your identity or affiliation
• Collect or track personal information about others without consent
• Use Sportobot for fraudulent, deceptive, or unauthorized purposes
• Access Sportobot from jurisdictions where its availability is prohibited

Unauthorized Access:

• Attempt to gain unauthorized access to our systems or networks
• Reverse engineer, decompile, or attempt to derive source code
• Bypass, disable, or circumvent security features or protections
• Scrape, crawl, or automatically collect data from Sportobot
• Use bots, automated scripts, or similar technologies (except those we explicitly allow)
• Modify, translate, or create derivative works based on Sportobot
• Remove, alter, or obscure any proprietary notices or labels

Interference:

• Disrupt, degrade, or impair the functionality or performance of Sportobot
• Interfere with other users' access to or use of Sportobot
• Attack Sportobot through denial-of-service or similar methods
• Share or distribute materials that could damage our reputation

Geographic/Jurisdictional Violations:

• Use Sportobot in violation of export control laws or sanctions regulations
• Operate Sportobot from prohibited countries or to prohibited users

4. User-Generated Content

4.1 Content Ownership and License

You retain ownership of content you create and upload ("User Content"). By uploading User Content to Sportobot, you grant us a:

• Perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, distribute, and display your content
• Right to sublicense these rights to other users and service providers
• Right to create derivative works (e.g., edited versions, compilations)

4.2 Your Representations

By uploading User Content, you represent and warrant that:

• You own or have permission to use all content you upload
• Content does not infringe third-party intellectual property rights
• Content complies with all applicable laws
• You have obtained all necessary permissions (e.g., from individuals in photos/videos)
• You are responsible for accuracy and truthfulness of content

4.3 Content Moderation

We reserve the right to:

• Review, remove, or restrict User Content that violates these Terms
• Remove content without notice in cases of illegal activity or abuse
• Enforce moderation based on community standards
• Suspend or terminate accounts for repeated violations

4.4 No Compensation

We do not compensate users for User Content. Your participation is voluntary.

5. Intellectual Property Rights

5.1 Sportobot Intellectual Property

All content, features, functionality, and materials comprising Sportobot (including design, text, graphics, logos, icons, images, sound recordings, and code) are the exclusive property of Sportobot or its licensors and are protected by copyright, trademark, and other intellectual property laws.

5.2 Limited Usage Rights

You may not:

• Reproduce, modify, distribute, display, or transmit any part of Sportobot's content except as permitted by these Terms
• Use Sportobot's trademarks, logos, or brand elements without permission
• Reverse engineer, decompile, or attempt to derive our technology
• Create competing products based on Sportobot

5.3 Feedback and Suggestions

Any feedback, suggestions, or improvements you provide to Sportobot ("Feedback") may be used by us without compensation or attribution. You grant us the right to use such Feedback for any purpose.

6. Third-Party Services and Integrations

6.1 Third-Party Links

Sportobot may contain links to third-party websites, applications, and services not operated by us. We are not responsible for:

• The availability, accuracy, or content of third-party services
• Privacy practices, terms of service, or conduct of third parties
• Any transactions or interactions with third parties

6.2 Third-Party Integrations

Sportobot integrates with third-party services (e.g., Apple Sign-In, Google Sign-In, social media platforms, payment processors). Your use of these integrations is governed by their respective terms and privacy policies. We are not responsible for their operations or practices.

6.3 No Endorsement

Links to or integration with third-party services do not constitute endorsement, approval, or affiliation with those services.

7. Payments and Financial Transactions

7.1 Pricing and Fees

• Sportobot may offer free and paid features
• Pricing and features are subject to change with notice
• All prices are listed in the currency specified at purchase

7.2 Payment Processing

• Payments are processed through third-party payment providers (e.g., Apple Pay, Google Pay, Stripe, GoPay)
• We do not handle or store full credit card information
• Payment providers' terms and security policies apply

7.3 Subscriptions and Auto-Renewal

If applicable:

• Subscriptions auto-renew at the end of each billing period
• You can cancel auto-renewal through your app store account settings or our settings page
• Cancellation takes effect at the end of the current billing cycle
• No refunds are provided for partial billing periods

7.4 Refunds

• Refunds are available within 14 days of purchase (app store policy)
• Refund requests should be made through the respective app store
• Sportobot reserves the right to deny refunds for abuse or violations of these Terms

7.5 Taxes

You are responsible for any applicable taxes, duties, or other government charges associated with your use of Sportobot. We will collect taxes as required by applicable law.

8. Disclaimer of Warranties

8.1 "As-Is" Service

Sportobot is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim:

• Implied warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties regarding uninterrupted, error-free, or secure operation
• Warranties about accuracy, completeness, timeliness, or reliability of content

8.2 No Guarantee of Results

We do not guarantee that:

• Sportobot will meet your requirements or expectations
• Features will function without interruption or errors
• Bugs or defects will be corrected
• Use of Sportobot will produce specific results

8.3 Your Sole Remedy

Your sole remedy for dissatisfaction with Sportobot is to discontinue use.

9. Limitation of Liability

9.1 Caps on Liability

To the maximum extent permitted by applicable law, Sportobot's total liability for any claims arising from your use of the Service is limited to the amount you paid (if any) in the 12 months preceding the claim. If you have not paid anything, liability is limited to €100 or the equivalent in your local currency.

9.2 Excluded Damages

In no event shall Sportobot be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, use, goodwill, or reputation
• Damages arising from your inability to use Sportobot
• Damages from unauthorized access or data breaches beyond our reasonable control
• Any damage or loss caused by third parties

9.3 Liability Waiver for User Interactions

We are not liable for:

• Disputes between users
• Harassment, threats, or abuse by other users
• Accuracy of user-provided information
• User conduct or actions
• Loss or damage to property or persons resulting from event participation

10. Indemnification

You agree to indemnify, defend, and hold harmless Sportobot and its officers, directors, employees, agents, and successors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your violation of these Terms
• Your violation of any law or third-party rights
• Your User Content
• Your use of Sportobot
• Disputes with other users

11. Termination and Account Suspension

11.1 Termination by You

You may terminate your account at any time by:

• Accessing account settings and selecting "Delete Account"
• Emailing us at info@sportobot.com with a termination request
• Upon termination, we will delete your account data (subject to legal retention requirements)

11.2 Termination by Sportobot

We may suspend, restrict, or terminate your account without notice if:

• You violate these Terms
• Your conduct is harmful to other users
• You engage in illegal activity
• You create multiple accounts to circumvent restrictions
• Your account poses a security risk

11.3 Effects of Termination

• Your access to Sportobot is immediately revoked
• Your account data may be deleted (subject to legal requirements)
• Sections of these Terms that should survive (liability, indemnification, intellectual property) remain in effect

12. Privacy and Data Protection

Your use of Sportobot is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

You acknowledge and consent to:

• Collection and processing of your personal data as described in the Privacy Policy
• Transfer of data to countries outside your country of residence
• Use of your data for analytics, marketing, and service improvement

13. User Conduct Standards

13.1 Community Guidelines

By using Sportobot, you commit to:

• Treating other users with respect and dignity
• Using the Service only for lawful purposes
• Not interfering with other users' enjoyment of Sportobot
• Providing accurate information
• Respecting intellectual property and privacy rights

13.2 Reporting Violations

If you encounter violations of these Terms, please report them to info@sportobot.com with details and evidence.

14. Dispute Resolution

14.1 Informal Resolution

Before initiating formal legal proceedings, you agree to attempt informal resolution:

• Contact us at info@sportobot.com with details of your dispute
• We will attempt to resolve the matter within 30 days
• In good faith, both parties will attempt negotiation and compromise

14.2 Governing Law

These Terms are governed by the laws of the Czech Republic, without regard to its conflict of law principles.

14.3 Jurisdiction and Venue

For EU/EEA Residents:

• You may bring claims in your local courts (optional consumer protections apply)
• Sportobot may bring claims in courts of your jurisdiction or the Czech Republic

For Other Residents:

• You agree to submit to the exclusive jurisdiction of courts in the Czech Republic
• You waive any objection based on inconvenient venue or lack of personal jurisdiction

14.4 Arbitration (if applicable)

For disputes not resolved informally, you may pursue binding arbitration instead of court proceedings (subject to applicable law). Arbitration procedures and rules will be specified in separate arbitration agreements if applicable.

14.5 Limitation Period

All claims must be brought within 2 years of the date the cause of action arises. Claims brought after this period are barred.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, severed. The remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other policies or guidelines referenced herein, constitute the entire agreement between you and Sportobot regarding your use of the Service and supersede all prior agreements, understandings, and representations.

17. Waiver

No waiver of any provision or breach of these Terms is effective unless in writing and signed by an authorized representative of Sportobot. A waiver of one breach is not a waiver of any subsequent breach.

18. Assignment

You may not assign, sublicense, or transfer your rights under these Terms. Any attempted assignment is void. Sportobot may assign these Terms to its successors or acquirers without your consent.

19. Notice of Changes

We may modify these Terms at any time. Material changes will be notified to you via email or through a prominent notice on Sportobot. Your continued use following notification constitutes acceptance.

22.1 Event Participation Waiver

By using Sportobot to organize or participate in sports events, you acknowledge:

• Sports participation carries inherent risks of injury or death
• You voluntarily assume all risks associated with event participation
• You release Sportobot and event organizers from liability for injuries or losses
• You are responsible for obtaining appropriate insurance or waivers

22.2 Information Accuracy

While we strive for accuracy, Sportobot does not guarantee:

• Event details are accurate or current
• Participant information is verified
• Results and statistics are error-free

You should verify critical information independently.

22.3 Third-Party Events

Sportobot is a platform for organizing and managing sports events. We do not organize or operate events. Event organizers are responsible for event conduct, participant safety, and compliance with applicable laws. We disclaim liability for event-related incidents.

23. Compliance with Laws

You agree to comply with all applicable laws, regulations, and ordinances in your jurisdiction. Sportobot is not available in certain jurisdictions where prohibited by law.

24. Export Controls

Sportobot may be subject to export control laws and sanctions regulations. You agree not to access, download, or use Sportobot from prohibited countries or for prohibited uses.
